DORA: Important reminder: submit information register by April 15

Financial entities must send the ACPR their register of information listing all their IT service providers. This register is a key tool for identifying critical service providers at European level. The deadline for submission is April 15, 2025.

Rebound in mortgage lending in February: an encouraging signal for the market

Banque de France announces a clear upturn in real estate lending in February 2025. Home loan production excluding renegotiations reached 10.7 billion euros, compared with 9.9 billion in January, marking a spectacular 55% year-on-year increase.

This upturn in activity is accompanied by a fall in the average rate on new loans, which stands at 3.27%, a level similar to that of June 2023. At the same time, first-time buyers account for over 50% of all purchases of primary residences, with average loan terms approaching 24 years. Outstanding home loans are down slightly (-0.5% year-on-year), but this upturn in production could reverse the trend.

 

 

Affinity insurance: when the loss of a telephone in transit is not covered

In a recent publicationthe Médiateur de l'Assurance clarified responsibilities in the event of loss of an insured telephone during transport to an approved repair center. A policyholder, who had taken out insurance for his telephone, made a claim following damage caused by a fall in the metro. In accordance with the terms of his contract, he sent his phone for repair, following the packing instructions provided.

However, when the package arrived, it was found to be empty. Faced with this situation, the insurer refused to cover the loss, pointing out that the contract stipulates that neither he nor the repair center are liable for loss or theft during transport, especially if the packaging was defective or not in conformity.

The insurance contract does not cover incidents during transport, which are the responsibility of the carrier. The insured was therefore invited to file a claim directly with the carrier to seek compensation.

Recommendation: If you are in a similar situation, it is essential to check whether your contract includes (or not) coverage for loss in transit. In the absence of such cover, you should contact the carrier for any claim, not the insurer.

 

 

Sustainability risks: ACPR takes stock

ACPR publishes a survey conducted in 2024 among 91 insurers and reinsurers on the integration of sustainability risks into their governance systems, as required by Solvency II rules since 2022. According to the authority, while all insurers and reinsurers have taken up the subject, progress levels remain heterogeneous.

Half of all organizations have integrated these risks into their written policies, particularly with regard to investment. However, the extent to which these risks are taken into account in underwriting and provisioning remains limited, despite the growing impact of climate and other environmental factors.

The ACPR is calling for enhanced risk assessment, the inclusion of long-term scenarios, and better training for the players involved.

 

Crypto-assets: AMF strengthens obligations to prevent money laundering and terrorist financing

The AMF publishes its position DOC-2025-02 to incorporate European Banking Authority ("EBA") guidance on restrictive measures to be applied by crypto-asset service providers. This position aims to ensure compliance with the European TFR 2 regulation on the fight against money laundering and terrorist financing.

Applicable from December 30, 2025, it concerns PSCAs (crypto-asset service providers) supervised by the AMF, as well as PSANs (digital asset service providers) benefiting from the transitional period before the full entry into force of the MiCA regulation in July 2026.

 

The French government convenes a "Roquelaure de l'assurabilité des territoires" (meeting on the insurability of territories)

In response to the growing difficulties faced by local authorities in gaining access to insurance, the government is organizing a "Roquelaure de l'assurabilité des territoires" on April 14. This one-day meeting will bring together the State, elected representatives and insurers, under the aegis of François Bayrou. The aim is to produce an Insurability Charter and an initial joint action plan. In this way, the government intends to respond to the warnings of many mayors faced with soaring premiums and policy cancellations.

Roquelaure is the name of the mansion in the 7th arrondissement of Paris where the Ministry of Ecological Transition is based.

 

 

Financial investments by insurers and pension funds remain stable overall in the fourth quarter of 2024

the Banque de France has published statistics on the outstanding financial investments of insurers and pension funds in Q42024.

At the end of December, this total stood at 2,721 billion euros, a slight decline of 10 billion on the previous quarter. This decline was mainly due to the depreciation of bond assets, against a backdrop of rising long-term interest rates. Investors reallocated their portfolios to long-term debt securities and non-money market funds, while reducing their exposure to money market funds.

 

Forex and cryptoassets: authorities warn of 23 new unauthorized sites

April 10, 2025

AMF and ACPR alert the public against 23 new sites illegally offering investments in Forex or crypto-asset derivatives.

These players are not authorized to operate in France. Blacklists of unauthorized sites are available on the AMF and ABEIS platforms. The authorities are calling for vigilance in the face of these often fraudulent offers.
