Tax doctrine on delegated management of insurance contracts evolves
VAT exemption: the tax authorities confirm the regime applicable to broker-managers, including co-brokerage. A long-awaited clarification, to which Astrée Avocats has actively contributed.
The French tax authorities have published an update of their tax doctrine following a rescrit, confirming the position defended by delegated broker-managers: delegated management of insurance policies, when associated with a commercial prospecting activity within the meaning of tax law, must benefit from the exemption regime provided for inarticle 261C 2° CGIincluding in the case of a commercial activity carried out within the framework of a co-brokerage agreement.
This publication by the tax authorities is to be welcomed, as it finally puts an end to the uncertainties that have governed the operational implementation of the tax doctrine on the exemption regime for insurance intermediaries, following an initial update in 2019.
Astrée Avocats supported the working group of broker-delegate managers in social protection, which contributed greatly to the adaptation of this tax doctrine in the interests of the profession.
